1. Who these terms are between
These terms of sale apply to every order placed on https://oem.industries (the "site") with OEM Industries, ⟨COMPANY_LEGAL_FORM⟩, ⟨COMPANY_REGISTRATION⟩, whose registered office is at ⟨COMPANY_ADDRESS⟩ ("we", "us"). Contact: contact@oem.industries.
They are written for consumers: people buying for their own use, outside a trade or profession. If you are buying for a business, write to us before ordering: some of what follows, in particular the right of withdrawal and the legal guarantees, exists for consumers only.
Placing an order means accepting the version of these terms in force on that day. The version is shown at the top of this page and recorded on your order.
2. What we sell
Three kinds of things are offered on the site:
- Printable files (digital content): a file you download and print yourself, in the formats listed on the part's page, together with every later revision of that file at no extra cost.
- Finished parts (goods): the same part manufactured by us, in the material and finish stated on the option you pick, then shipped to you. An option is either in stock or made to order; the lead time is stated on the option before you add it to the cart.
- Raw 3D scans: free downloads from the database, published under the Creative Commons Attribution 4.0 licence, to which you may add a voluntary contribution. Nothing in these terms restricts what that licence grants.
Every part is a reproduction, reverse-engineered by us from a verified original. It is not original equipment, it is not made or approved by the vehicle's manufacturer, and we are not affiliated with any manufacturer. Manufacturer names and part numbers appear only to identify what a part fits.
3. Account
An order requires an account, opened by signing in with a supported identity provider. You are responsible for the accuracy of the details you give us and for what is done under your account.
4. Ordering
An order is placed in four steps: the cart, your delivery details, the shipping option (for finished parts), then a review page where you accept these terms and, for an order containing files, the Personal Use Licence and, for files bought at their listed price, the waiver described in section 8. A scan downloaded with a contribution goes through the same review page. An order where nothing is paid but voluntary contributions, or nothing at all, asks you to tick nothing: placing it is accepting these terms, as the review page says. The button that places the order says what you will pay; pressing it commits you to paying it.
We confirm the order by email once payment has gone through. We may refuse or cancel an order for a legitimate reason (a payment that fails, an address that cannot be delivered to, an order that is abnormal in size or frequency) and will tell you why.
5. Prices
Prices are in euros, all taxes included, and are those shown at the moment you order. Shipping is charged in addition for finished parts and is shown before you place the order. A voluntary contribution, of whatever amount you choose, can be added to a raw scan or to an item listed as free. It is never required; once added, it is the price of that item, paid and treated like any other.
6. Payment
Payment is taken in full when the order is placed, by card through Stripe. We never see or store your card number. An order is processed only once payment has been confirmed.
7. Delivery
Finished parts are shipped to the address you gave, by the carrier and service you picked at checkout. The delivery time is the lead time stated on the option (the time it takes us to make or pick the part) plus the carrier's transit time. Unless a longer time was stated when you ordered, we deliver within thirty days of the order at the latest; if we cannot, you may cancel the order and be refunded in full.
The part is your responsibility from the moment you, or someone you appointed, receive it. Check the parcel on delivery and tell us within three days of anything missing or damaged, so we can act against the carrier.
Printable files are available for download from your order page as soon as payment is confirmed, and remain available there. Later revisions of the same file appear on the same page.
8. Right of withdrawal
As a consumer you may withdraw from an order without giving a reason within fourteen days of receiving the goods, by writing to contact@oem.industries or using the form at the end of these terms. Return the part to us within fourteen days of telling us, in a condition that allows it to be sold again; the cost of returning it is yours. We refund the price and the standard shipping you paid within fourteen days of receiving the part back or of proof that you have sent it.
The right of withdrawal does not apply to printable files bought at their listed price, once the download has been made available to you. On the review page, before paying for an order containing such a file, you are asked to expressly agree that the file is delivered immediately and to acknowledge that you lose your right of withdrawal as a result. Without that agreement the order cannot be placed.
A voluntary contribution on a raw scan, or on a file listed as free, asks for no such agreement: you may withdraw within fourteen days of the order, by the same means, and the contribution is refunded in full.
9. Warranties
Legal guarantee of conformity. Finished parts and printable files must match their description, including the fitment stated on the part's page. For finished parts the guarantee runs for two years from delivery: a defect that appears within that time is presumed to have existed at delivery, and you may ask for the part to be repaired or replaced, or, failing that, for a price reduction or a refund. For printable files, the guarantee covers the file's conformity at the time it is supplied and any update we make available. A claim under this guarantee costs you nothing.
Guarantee against hidden defects. Independently of the above, you are covered against hidden defects that make a part unfit for its purpose, under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect.
These guarantees are granted by OEM Industries. They do not cover damage caused by fitting a part incorrectly, by using it for something other than what it is for, or by a print you made yourself from a file: the file is what we warrant, not the printer, the material or the settings you used.
The wording of the statutory guarantee that French law requires traders to reproduce is inserted here in the version reviewed by our counsel.
10. Use and responsibility
Our parts are intended for the restoration and maintenance of the vehicles listed on their pages. Unless a part's page says otherwise, it is not certified for safety-critical use (braking, steering, structural or restraint systems) and must not be used there. Fitting is your responsibility, or that of the professional you entrust it to.
A file you print yourself becomes a part you made: its strength and fit depend on your printer, material and settings, and are outside what we can control or warrant.
Nothing in these terms limits our liability where the law does not allow it to be limited.
11. Intellectual property
The printable files remain our property. Buying one grants you the Personal Use Licence and nothing more: personal use, no resale, no commercial use, no redistribution. Raw scans are released under CC BY 4.0, under the terms of that licence. The site's other content (texts, photographs, videos) is protected by copyright and may not be reused without our permission.
12. Personal data
The data an order requires is processed as described in our Privacy policy.
13. Disputes
These terms are governed by French law. If something goes wrong, write to us first at contact@oem.industries; most problems are solved that way.
If we cannot settle it between us, you may refer the dispute free of charge to the consumer mediator we belong to: ⟨COMPANY_MEDIATOR_NAME⟩, ⟨COMPANY_MEDIATOR_URL⟩. Mediation is optional, and you may go to court instead: the courts of your home country if you live in the European Union.
